Platinum Credit has been ordered to pay Samuel Kamau Waweru KSh400,000 in compensation for unlawfully processing his personal data to send unsolicited loan promotions through calls and text messages. He had not consented to the marketing. Waweru lodged his complaint on 27 November 2024 after repeated approaches. The company denied that the caller was its agent, but the Office of the Data Protection Commissioner confirmed she was.
Data Commissioner Immaculate Kassait also issued an enforcement notice. Her determination, dated 24 February 2025, recommended prosecution of Platinum Creditโs directors for furnishing information they knew to be โfalse or misleadingโ, an offence under Section 57(3), read with Section 73, of the Data Protection Act. The parties had 30 days to appeal to Kenyaโs High Court.
